What the enacted statute generally contemplates
The enacted TOD framework contemplates a deed recorded during the owner's lifetime, without consideration or the beneficiary's signature (Georgia Code §44-17-2).
Older descriptions refer to a beneficiary acceptance affidavit supported by a death certificate and a nine-month post-death deadline, but HB 899 was reportedly considered to change that rule and its final status was not independently confirmed (Georgia General Assembly, HB 899; CitizenPortal.ai legislative coverage).
New statute, moving mechanics: Georgia's TOD deed became effective in 2024 and was reportedly amended in 2026. Confirm the live statute and any beneficiary-acceptance deadline with
legis.ga.gov or a Georgia attorney before signing or relying on a deed.
Medicaid recovery is the reason not to overpromise
Georgia's published Medicaid estate-recovery policy reaches all real property, jointly held personal property, joint-tenancy interests, and life-estate interests; it is not limited to a conventional probate estate (DFCS PAMMS §2398; Georgia Estate Recovery Rule).
Because a TOD deed is new and the located DFCS policy does not directly address its treatment, the thought that a deed may keep property outside probate while recovery can reach some non-probate interests is only an explanation of how the rules might interact, not a guarantee of protection (Georgia Code §44-17-2; DFCS PAMMS §2398).
Use the right comparison and the right advice
