Nursing Facility Level of Care review
New Mexico calls the care review Nursing Facility Level of Care, or NFLOC. HCA’s NFLOC material says the criteria and instructions define utilization-review requirements for New Mexico Medicaid programs that require an NF level of care and are intended to create a uniform, objective evaluation (HCA Nursing Facility Level of Care guidelines).
The Community Benefit policy materials also describe an NF LOC assessment performed by an MCO as part of the comprehensive needs assessment for Community Benefit services. This is why a family can face the same basic level-of-care framework whether the person seeks nursing-facility care or a community alternative (HCA Community Benefits policy manual).
Patient pay and the personal-needs allowance
HCA’s current 2026 ABD sheet lists a $97 Personal Needs Allowance, effective July 1, 2025. The institutional-care rule says the current PNA is protected from a nursing-facility resident’s monthly income for personal use, while excess income after other permitted deductions is applied toward care as a medical-care credit (HCA 2026 ABD Medicaid programs sheet; HCA 8.281.500 NMAC institutional-care rule).
That $97 figure is a protected personal-needs amount, not a guarantee that every other income item is ignored. Patient-pay calculations may also involve a community-spouse income allowance, health-insurance premiums, medical expenses, and other rule-specific deductions. The actual notice and current HCA policy should be reviewed before a facility billing decision is accepted.
Keep the clinical and financial work together
Admission planning should include the NFLOC evidence, the HCA financial application, bank and income records, and the facility’s patient-pay calculation. A care need alone does not decide financial eligibility, and financial eligibility alone does not replace the required level-of-care decision.
