Nursing-facility care is a SoonerCare long-term-care service

OHCA lists care in a nursing facility among Oklahoma’s categorically-needy long-term medical-care services. Its nursing-facility financial rule says that income, resources, and expenses are reviewed monthly, that the person must be categorically needy under the applicable standard, and that a person whose gross income exceeds the Schedule VIII.B standard is directed to the Medicaid Income Pension Trust rule (OHCA long-term medical-care rule; OHCA nursing-facility financial-eligibility rule).

The current Appendix C-1 gives the long-term-care income standard as $2,982 per month and the individual resource standard as $2,000. It also says that a person residing in a nursing facility or ICF/IID has a $75 monthly maintenance standard, which is the amount the client may retain for personal needs. A patient-liability calculation requires the real income, medical deductions, spouse information, and care setting; the $75 is not a complete budget (OKDHS Appendix C-1).

Level of care is an independent requirement

Oklahoma’s levels-of-care rule sets criteria for deciding whether a person seeking SoonerCare long-term-care payment needs Skilled Nursing Facility or ICF/IID level of care. It applies to both facility services and HCBS waivers and describes the review as a determination of the person’s physical, mental, and social or emotional status to identify the appropriate level of care. Meeting the financial rules does not substitute for this review (OHCA levels-of-care rule).

OHCA’s provider information identifies the Level of Care Evaluation Unit, commonly abbreviated LOCEU, in connection with long-term-care and waiver services, and its long-term-care provider page lists PASRR among the program areas. PASRR addresses specialized screening and review for certain nursing-facility applicants; it should not be confused with the broader Medicaid financial review or the basic level-of-care determination (OHCA long-term-care and waiver provider information; OHCA levels-of-care rule).

Income and veterans benefits can change the calculation

For a veteran or surviving spouse who meets the federal conditions for the reduced $90 VA pension while living in a SoonerCare-approved nursing facility, OHCA says the reduced pension is not used in computing vendor payment or spenddown, and the resident is entitled to that $90 in addition to the regular nursing-facility maintenance standard. This is a specific VA rule, not a general rule that all veterans benefits are excluded (OHCA VA-income policy).

After admission, estate-recovery and home-lien rules may also matter. OHCA’s recovery policy discusses a lien after the required return-home determination and family protections; it is not part of the initial financial limit but should be considered before long-term title changes are made (OHCA Medicaid recovery rule).
