Why Michigan runs differently
Michigan long-term care Medicaid is not one unified benefit. MDHHS administers nursing-facility Medicaid alongside the MI Choice home- and community-based waiver and PACE (MDHHS, MI Choice Waiver Program; MDHHS, PACE).
The state's defining home-planning feature is the Lady Bird deed. The Michigan Supreme Court's Rasmer decision recognized it as an estate-planning tool to avoid probate (MSU Extension; State Bar of Michigan Journal).
What makes Michigan genuinely different from other states
- The Lady Bird deed is a Michigan signature. The owner keeps power to use, sell, mortgage, or change beneficiaries during life, and an unrevoked deed passes title outside probate at death (State Bar of Michigan Journal) — see the Michigan Lady Bird deed page.
- That deed has a direct estate-recovery role. MDHHS describes recovery as probate-based, while Lady Bird deed property passes outside probate under current rules (MDHHS Estate Recovery; MSU Extension).
