Level of care and financial rules remain central

Community Choices requires nursing-facility level of care. The same clinical standard is relevant to nursing-facility care, where CLTC nurse consultants review skilled or intermediate level of care. A person can prefer care at home, but waiver enrollment still requires that clinical finding and the applicable Medicaid financial eligibility determination (SCDHHS Community Choices Waiver; SCDHHS Nursing Facilities).

The income-cap issue also applies to the relevant HCBS route. South Carolina's manual says an Income Trust may be established for a person seeking HCBS whose gross income is above the special Medicaid cap, while CMS lists $2,982 as the 2026 300%-of-SSI amount. That makes care-at-home eligibility a financial-planning question as well as a care-planning question (SCDHHS MPPM Chapter 304; CMS 2026 standards).

Waiting lists and enrollment caps

SCDHHS publishes waiver approvals and renewal materials with maximum-unduplicated-participant information, but this research did not locate a live statewide Community Choices wait-list count on the consumer program page. Enrollment capacity can change; confirm current availability with CLTC at the time of application rather than relying on a historical waiver table (SCDHHS Community Choices Waiver).

For the developmental-disability system, the state behavioral-health agency says that the Intellectual Disability/Related Disabilities and Community Supports waivers have waiting lists. That statement should not be generalized to every South Carolina waiver, and it does not establish the current length of either list (South Carolina BHDD waiver information).

A prompt application, documentation of care need, and follow-up on clinical review can be important where home care is needed quickly. If home-based services cannot begin immediately, the family may need an interim care plan that does not assume waiver approval or a particular start date.
