Mississippi treats DOM as an estate creditor
Mississippi Medicaid estate recovery is administered by DOM. Mississippi Code §43-13-317 says the Division must be noticed as an identified creditor against the estate of a deceased Medicaid recipient and may seek recovery in accordance with federal law. DOM’s consumer page says recovery is from real or personal property in the recipient’s estate, up to the value of relevant Medicaid payments (Mississippi Code §43-13-317; DOM Estate Recovery page).
The published sources identify recipients age 55 or older as the principal group and describe nursing-facility services, home- and community-based services, and related hospital and prescription-drug services as covered recovery categories. DOM’s overview frames the program around people age 55 or older who were in a nursing facility or HCBS waiver program at death (DOM Estate Recovery page; Mississippi Code §43-13-317).
