Ohio uses an expanded estate-recovery definition

Ohio's Medicaid estate recovery program is governed by Ohio Revised Code section 5162.21. The Ohio Attorney General's Office pursues claims on ODM's behalf (Ohio Revised Code § 5162.21; OAC 5160:1-2-07).

Ohio does not limit recovery to the probate estate. Its definition also reaches specified real and personal property interests passing to a survivor, heir, or assign through joint tenancy, tenancy in common, survivorship, life estate, living trust, or other arrangement (Ohio Revised Code § 5162.21).
