Ohio's statutory instrument is the Transfer on Death Designation Affidavit, not a transfer-on-death deed in the technical sense. It functions similarly to TOD deeds used elsewhere by allowing an owner to designate one or more beneficiaries for a real-property interest at death (Ohio Revised Code § 5302.22).

A sole owner, tenant in common, survivorship tenant, or spouses who hold as tenants by the entireties may designate all or a specified part of an interest, subject to the statute's rules. The instrument can therefore be a probate-avoidance tool, but not a one-size-fits-all Medicaid strategy (Ohio Revised Code § 5302.22).
