Wisconsin recovery reaches more than probate

Wisconsin's Estate Recovery Program seeks repayment for specified long-term-care services paid through Medicaid, BadgerCare Plus, Community Options Program, and non-Medicaid Family Care, as well as services paid by the Wisconsin Chronic Disease Program. DHS says recovery may come from the member's estate, the surviving spouse's estate, certain non-probate property, and liens filed on a home (Wisconsin Estate Recovery Program Handbook).

The handbook distinguishes an older community member from someone receiving long-term-care services. A person age 55 or older living in the community and not receiving long-term-care-related services is not affected by recovery, while the handbook lists nursing-home, home-care, and community long-term-care benefits within the recovery framework (Wisconsin DHS Estate Recovery Program overview).

Defined non-probate interests can be reached

DHS lists life estates, joint tenancy, life insurance, most trust property, and property payable or transferable on death among non-probate property. Its published recovery list includes life estates, non-bank joint-tenancy property, life insurance payable to a living beneficiary, and revocable trusts created on or after August 1, 2014, as well as other non-probate property for members who die on or after that date (Wisconsin Estate Recovery Program Handbook).

DHS says it uses an affidavit of the administrator to pursue non-probate property and may file liens on non-probate real property. The handbook also describes pre-death TEFRA liens for a permanently institutionalized person's home, subject to the federal protections for a surviving spouse and certain children, and post-death estate liens in stated circumstances (Wisconsin Estate Recovery Program Handbook).

There is an undue-hardship process

An heir, beneficiary, or qualifying co-owner may seek a hardship waiver of DHS's claim on that person's share. DHS lists hardship where recovery would make the person eligible for or remain eligible for SSI, FoodShare, BadgerCare Plus, or Medicaid; where recovery of a business property such as a working farm would eliminate livelihood; or where the person receives need-based veterans benefits (Wisconsin Estate Recovery Program Handbook).

For probate or affidavit cases, the person handling the estate receives notice of the right to apply and is responsible for notifying heirs and beneficiaries. For non-probate property, DHS says co-owners and beneficiaries receive notice and may seek a waiver only for their own share. The handbook also describes fair-hearing rights in the non-probate process (Wisconsin Estate Recovery Program Handbook).
