VA Aid and Attendance has a Wisconsin Medicaid rule

VA describes Aid and Attendance as an added monthly payment for qualifying veterans and survivors who receive VA pension and need regular help with activities such as bathing, feeding, or dressing, are nursing-home patients because of disability-related loss of ability, are bedridden, or meet specified vision criteria. VA says Aid and Attendance cannot be received at the same time as Housebound benefits (VA Aid and Attendance and Housebound guidance).

Wisconsin's Medicaid handbook provides a valuable state-specific treatment: Aid and Attendance and Housebound allowances are disregarded for every Medicaid eligibility category, and are also disregarded in Institutional Medicaid patient-liability and Community Waivers cost-share calculations. The handbook expressly notes an exception to that liability rule for certain State Veterans Home residents without dependents (Wisconsin Medicaid Eligibility Handbook 26-03).

Three Wisconsin State Veterans Homes

The Wisconsin Department of Veterans Affairs operates three Veterans Homes: Chippewa Falls, King, and Union Grove. WDVA says they provide 24-hour skilled nursing care and serve nearly 1,000 veterans and spouses, although each facility's admission, availability, and payment arrangements should be confirmed directly with the home (Wisconsin Veterans Homes information).

For a veteran or surviving spouse without dependents who resides in a State Veterans Home, the Wisconsin handbook says that if VA pension is $90 or less, the full pension is exempt from patient liability; if it exceeds $90, only $90 is exempt. In that special situation the Aid and Attendance, Housebound, or unreimbursed-medical-expense portion is included in patient liability when the pension exceeds $90, even though it remains disregarded for Medicaid eligibility (Wisconsin Medicaid Eligibility Handbook 26-03).

A Wisconsin property-tax benefit may also matter

Wisconsin offers a veterans and surviving spouses property tax credit equal to property taxes paid on an eligible principal dwelling. It is claimed on the Wisconsin income-tax return, and the applicant must obtain Wisconsin Department of Veterans Affairs eligibility verification before the first claim; the Department of Revenue page states a Wisconsin-residency condition of at least five consecutive years at any time after entry into active service (Wisconsin Department of Revenue veterans property-tax credit qualifications).

VA also has a separate federal $90 pension-rate rule for people without dependents in Medicaid-covered nursing facilities: if VA awards that rate, the facility cannot count it toward cost of care and the person keeps the $90 for personal expenses (VA guidance on the $90 Medicaid-facility pension rate). The pension, Home, and Medicaid rules should be evaluated together.

Wisconsin rule: Aid and Attendance is generally disregarded for Medicaid eligibility and long-term-care liability, but State Veterans Home residents without dependents have a special patient-liability rule (Wisconsin Medicaid Eligibility Handbook 26-03).
