The 2026 penalty is calculated in days

Wisconsin's published penalty formula divides the divested amount by the average daily private-pay nursing-home rate. The current rate is $352.06 per day, effective January 1, 2026, and the handbook's example divides $18,500 by that figure to produce a 52-day penalty after the fractional day is disregarded (Wisconsin Medicaid Eligibility Handbook 26-03).

A divestment penalty affects long-term-care services rather than ordinary Medicaid card services, and it runs uninterrupted once it starts. For an applicant it begins only after the application or waiver request, institutional or functional eligibility, and the other financial and nonfinancial requirements are met. That timing is why a dollar figure alone cannot predict the actual uncovered-care period (Wisconsin Medicaid Eligibility Handbook 26-03).

Deeds and exemptions require case-specific review

The handbook lists transfers for fair market value, certain exempt assets, some transfers to a spouse or disabled child, qualifying caretaker-related homestead transfers, and other listed transactions among the categories that may not be treated as divestments. It also specifically says that, for a real-property transfer, the Medicaid date is the date a quitclaim deed was signed and notarized or authenticated by an attorney, not the county recording date (Wisconsin Medicaid Eligibility Handbook 26-03).

A transfer-on-death designation is governed by different property law: ownership is not affected until death. Its Medicaid transfer and recovery consequences should therefore be reviewed in light of the actual title, other transfers, and Wisconsin's separate expanded-recovery rules rather than treated as an automatic five-year-planning solution (State Bar of Wisconsin TOD-deed explanation; Wisconsin Estate Recovery Program Handbook).
